Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Chatbot Widget AI website and service operated by Chatbot Widget AI, Inc. ("us", "we", "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Accounts

Our service allows you to integrate an AI-powered chatbot into your website(s). You are responsible for your use of our services and for any content that you create, transmit, or display while using our services.

You agree that you will not use our service for any purposes that are illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

You agree not to:

• Use the service for any illegal purpose or to transmit illegal content
• Use the service to send spam, unsolicited mass messaging, or marketing
• Collect or harvest any personally identifiable information from the service
• Use the service for competitive analysis or to build a competing product
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
• Interfere with or disrupt the service or servers or networks connected to the service
• Attempt to probe, scan, or test the vulnerability of the system or breach any security or authentication measures
• Reverse engineer or decompile any parts of the service

3. API Usage and Rate Limits

Your subscription plan includes a monthly allowance of chatbot interactions. If you exceed this allowance, we reserve the right to limit your access or charge you for additional usage according to our current rates.

We also implement rate limits on our API to maintain the quality of service for all users. Exceeding these rate limits may result in temporary suspension of service access until the rate limit period resets.

You agree not to circumvent or attempt to circumvent any rate limiting mechanisms implemented in the service.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Chatbot Widget AI, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Chatbot Widget AI, Inc.

You retain any rights to your data and content. By using our Service and providing content to train or customize the chatbot, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of providing and improving the Service.

5. Content Ownership and AI-Generated Content

You retain ownership of any content you provide to our service, including texts, data, or configurations used to train or customize your chatbot.

Regarding AI-generated content provided by our chatbot:

• Responses generated by our AI chatbot are provided for informational purposes only and may not always be accurate or complete.
• You are responsible for reviewing and validating any AI-generated content presented to your site visitors.
• We do not claim ownership over the specific responses generated by the AI chatbot in conversations with your website visitors.
• We reserve the right to use anonymized conversation data to improve our service.

6. Limitation of Liability

In no event shall Chatbot Widget AI, Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use or alteration of your transmissions or content,

whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Chatbot Widget AI, Inc., its subsidiaries, affiliates, and its licensors do not warrant that:

• The Service will function uninterrupted, secure or available at any particular time or location;
• Any errors or defects will be corrected;
• The Service is free of viruses or other harmful components; or
• The results of using the Service will meet your requirements.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service, or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
